Terms of Service

1. Eligibility and account responsibility

You must be at least 13 years old and use a registered account for account-based features. You are responsible for accurate account information, safeguarding credentials, maintaining access to your sign-in method, and activity under your account. Do not create an account for another person without consent or attempt to use another person’s account.

2. Shared and Personal modes

Capsoul is a shared memory capsule. Trusted sharing, waiting, and reopening memories together are central to the service. The app supports Shared and Personal modes. You retain ownership of content you create and grant Capsoul a limited, non-exclusive license to store, process, release, deliver, and protect it only as needed to operate the service.

A new Shared Capsoul uses one server-owned unit for one to five recipients and may wait up to five calendar years. A Personal Capsoul uses a UTC-month allowance, stays locally encrypted, has a 30-day opening horizon, and is subject to a decimal 50 MB optimized-media limit. Current quantities, new Shared media limits, historical compatibility, withdrawal, and availability rules are set out in the Purchase & Preservation Policy.

3. Recipients, addresses, and consent

For a Shared Capsoul, you must have an appropriate basis to contact every recipient and share the selected content. You are responsible for entering each email address, phone number, or account recipient accurately and for confirming any unregistered email before sending. Do not misrepresent who is sending, add a person without an appropriate relationship or consent, or expose another person’s private information.

4. StoreKit purchases, memberships, and refunds

Optional Consumables and memberships offered inside the iOS app use Apple StoreKit and Apple In-App Purchase. A purchase or membership binds to the first Capsoul account on which its Apple transaction or subscription is successfully verified and cannot be transferred between Capsoul accounts. The service owns balance, grant, reservation, settlement, and refund-adjustment records.

Consumables are not normally re-granted by Restore Purchases after durable settlement, though Capsoul may verify unfinished transactions. Restore Purchases can restore eligible non-consumable entitlement or subscription state under Apple’s rules. Apple manages prices, tax, payment, renewal, cancellation, subscription management, Restore Purchases eligibility, and refund decisions. Verified refunds may reduce available Shared units, stop future grants from a refunded paid period, or create an adjustment; they do not retract a committed Shared memory or erase a delivered local file.

5. Local documents and conditional cloud cleanup

Personal text and media are encrypted with AES-256-GCM in an account-bound local .capsoul document. Capsoul does not provide cloud storage, synchronization, discovery, or backup for the Personal payload. You are responsible for device storage, the encrypted document, account access, and any user-managed backup.

When the lifecycle feature is enabled and its claim rules are satisfied, an eligible Shared local document may be saved after opening. Once required durable local copies are confirmed or the applicable claim period ends, its eligible media may then be removed from cloud storage. This behavior is conditional, may be rollout-gated, and does not promise remote recovery. A file already controlled by another person’s device cannot be remotely revoked or deleted.

6. Safety, reports and blocks

You may not send illegal, harmful, threatening, harassing, defamatory, deceptive, infringing, exploitative, or privacy-invasive content; impersonate others; distribute malware; abuse invitations, reports, or purchases; evade blocks or enforcement; attempt unauthorized access; or disrupt the service.

Recipients may submit eligible content or account reports and blocks. A report does not guarantee a particular result, but Capsoul may preserve a limited evidence snapshot, investigate, restrict delivery, hide content, suspend an account, cooperate with lawful requests, or take other proportionate action. Blocking prevents specified future interactions under app rules. Safety records are normally retained for the stated review period and may be retained longer when reasonably required for an active investigation, fraud prevention, dispute handling, legal hold, or law.

7. Account deletion and Apple subscription cancellation

You may request account deletion from Profile in the app or through Support after verification. Deletion may remove or anonymize service-side account data, erase the remaining Shared balance, stop future membership grants, and attempt to remove that account’s Personal packages and keys from the current device after server deletion succeeds, subject to limited security, purchase, safety, dispute, and legal retention.

Deleting your Capsoul account does not cancel an Apple subscription. Cancel or manage the subscription separately through Apple, preferably before deleting the Capsoul account. Capsoul account deletion also cannot remotely erase local copies already controlled by another person’s device.

8. Service availability

Capsoul is provided “as is” to the extent permitted by law. We work to provide reliable delivery but do not guarantee uninterrupted, error-free, or permanent availability. Products and lifecycle features may remain unavailable or rollout-gated until enabled for an account and app release. Keep account and device information current and maintain appropriate backups of local documents.

9. Disclaimer and liability

To the extent permitted by law, Capsoul disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by applicable law, Capsoul and its creators are not liable for indirect, incidental, special, or consequential damages arising from use of the service. Nothing in these Terms limits rights or liability that cannot lawfully be excluded.

10. Governing law, changes, and contact

These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law principles. We may update them and will provide appropriate notice of material changes. Continued use after the effective date means you accept the revised Terms.
